Section 610 of the RFA requires agencies to periodically review rules that have a significant economic impact on a substantial number of small entities.

    Each agency shall publish in the Federal Register a plan for the periodic review of rules issued by the agency which have or will have a significant economic impact upon a substantial number of small entities, and shall review each such rule within ten years of promulgation to determine whether it should be continued without change, or amended or rescinded, to minimize any significant economic impact on small entities.

    Establishes: A statutory small-business review track that runs independently of any Executive Order and cannot be bypassed by inaction.

    Plain English: EPA must periodically revisit rules that hit small businesses hard. § 610 is a lever to force reassessment of diesel rules whose small-shop burden was not fully accounted for.
